Terms of Use

1. Purpose

The purpose of these Terms of Use is to define the terms and conditions under which users (hereinafter "the Candidate") use the interview simulation service (hereinafter "the Service") provided by Namua Consulting, accessible at https://namua.ai. By accessing and using the Service, the Candidate unreservedly accepts these Terms of Use.

2. Description of the Service

The Service allows the Candidate to:

  • Create a personal account;
  • Pay for an interview simulation session;
  • Log in to the platform;
  • Provide a description of the targeted position;
  • Upload their CV;
  • Conduct a virtual interview simulation with an AI-powered recruiter;
  • Receive feedback on their performance.

Maximum simulation duration

The duration of an interview simulation is strictly limited to one hour (1h). Beyond this limit, the session is automatically terminated, and no partial or full refund may be claimed.

No knowledge of actual company practices

The interview simulation relies exclusively on the information provided by the Candidate and on generic position analysis models. The Service has no internal knowledge of the actual practices, processes, criteria, methods, or recruitment policies of real companies. The questions, assessments, and feedback generated therefore do not reflect the exact conditions of an interview conducted by a specific company.

3. Technical operation

The virtual recruiter is powered by artificial intelligence engines (language models, speech-to-text and text-to-speech) operated by third-party providers such as OpenAI, Mistral AI, Deepgram, Gladia or Google. Depending on the Service configuration, one or more of these providers take part in the simulation: their exact list and role are detailed in section 4.3 and in the privacy policy below. These engines generate the dialogues and interactions during the simulated interview. Warning: The Service is not responsible for the content generated by these AI systems, nor for the management of data processed by these engines.

Liability related to AI-generated content

The content generated by the AI is produced automatically, without human intervention. Namua Consulting acts as a technical intermediary, in accordance with Article 6-I-2 of French Law No. 2004-575 (LCEN). Namua Consulting shall not be held liable for any statements, advice, or analyses produced by the AI engine. Any inappropriate or discriminatory content may be reported to contact@namua.ai for removal.

4. Personal data

4.1 Data collection

The Service collects only the data strictly necessary for its proper operation:

  • Candidate's CV;
  • First name and last name;
  • Position description;
  • Data generated during the interview;
  • Email address;
  • IP address and connection data;

Audio data

During the simulation, audio streams are transmitted to enable real-time interaction between the Candidate and the virtual recruiter. These streams are sent in real time to a speech-to-text provider (see section 4.3) to be converted into text, and the text of the exchanges is sent to a language model (AI) provider and a text-to-speech provider to produce the virtual recruiter's replies. These streams may be temporarily recorded and retained for a maximum period of fourteen (14) days, solely for the purpose of ensuring the proper operation of the Service, resolving any technical incidents, or improving the quality of simulations.

These recordings are accessible only to authorised Namua Consulting personnel and are automatically deleted at the end of this period, unless otherwise required by law. They are never used for commercial, advertising, or algorithm training purposes without the Candidate's explicit consent.

4.2 Retention period

The CV and position description are automatically deleted within a maximum period of three (3) months from the date of the interview simulation, unless otherwise required by law.

4.3 External service providers and limitation of liability

The Service implements all reasonable measures to ensure the security and confidentiality of data. However, certain data is transmitted to external service providers, solely within the scope of the Service's technical operation:

  • language models (AI) -- OpenAI or Mistral AI: the CV, the position description, the text of the exchanges and the interview context are used to generate questions, replies and feedback;
  • speech-to-text -- Deepgram, Gladia or Mistral AI: the audio of the Candidate's voice is sent to be converted into text;
  • text-to-speech -- Google Cloud, Deepgram or Mistral AI: the text of the virtual recruiter's replies is sent to be turned into speech;
  • payment -- Stripe: payment details are entered directly with Stripe; Namua Consulting does not keep them;
  • form security -- Google reCAPTCHA: anti-bot analysis when registering and when sending a message through the contact form;
  • email delivery -- transactional email provider (address confirmation, password reset, notifications);
  • audience measurement -- Plausible Analytics: traffic statistics without cookies or profiling.

The choice of AI, speech-to-text and text-to-speech providers depends on the Service configuration and may change; each simulation uses only some of them. The up-to-date list is given in the privacy policy below.

These service providers may temporarily process data (e.g. audio content, interview text, payment information) to deliver their services. Namua Consulting has no control over their systems, their retention policies, or the use they make of the data. Accordingly, Namua Consulting disclaims all liability regarding any processing, retention, disclosure, or use carried out by these external service providers.

The Candidate is expressly advised not to transmit sensitive, confidential, or unnecessary information during the interview simulation.

5. Payment and right of withdrawal

Access to the simulation is conditional upon prior payment of the amount indicated on the platform. No refund shall be issued after the simulation has started, except in the event of a technical malfunction attributable to the Service.

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content executed immediately after payment, provided that the consumer has given their prior consent and waived their right of withdrawal. By launching the simulation, the Candidate expressly acknowledges waiving this right.

6. Candidate's obligations

  • Use the Service fairly and in accordance with its intended purpose;
  • Provide accurate information;
  • Not misuse the Service for fraudulent, malicious, or unlawful purposes;
  • Acknowledge that the Service is a simulation and does not constitute certified professional advice in recruitment or career guidance.

7. Intellectual property

All elements specifically created for the Service (texts, algorithms, source code developed by Namua Consulting, interface, generated content, etc.) are the exclusive property of Namua Consulting.

Certain elements of the Service (notably the graphic design and 3D models) originate from third-party sources and are used by Namua Consulting in compliance with their respective licences (purchased licences, royalty-free resources, or open-source licences). These elements remain the property of their authors or rights holders.

Accordingly, any unauthorised reproduction, distribution, or reuse of protected elements belonging to Namua Consulting or its partners is prohibited.

"Namua", "Namua.ai", and the associated logo are registered trademarks owned by Namua Consulting. Any unauthorised use constitutes infringement within the meaning of Articles L713-2 et seq. of the French Intellectual Property Code.

8. Liability

The Service is provided "as is" without any guarantee of results. Namua Consulting disclaims all liability:

  • in the event of errors generated by the AI;
  • in the event of misinterpretation of feedback;
  • in the event of internet connection issues;
  • or misuse of the Service.

Limitation of liability: In any event, the liability of Namua Consulting, for all causes combined, is strictly limited to the amount paid by the Candidate for the service in question.

Availability: Namua Consulting does not guarantee continuous, uninterrupted, or error-free access to the Service. The Service may be suspended for maintenance, updates, or outages beyond the control of Namua Consulting.

Force majeure: Namua Consulting shall not be held liable in the event of unforeseeable and irresistible external events (e.g. natural disasters, widespread internet outages, cyberattacks, third-party server failures).

9. Termination and account deletion

The Candidate may delete their account at any time. Namua Consulting may suspend an account in the event of a breach of the Terms of Use or fraudulent use.

10. Amendments

Namua Consulting reserves the right to amend the Terms of Use at any time. Substantial amendments shall be notified by email at least 15 days before they take effect.

11. Applicable law and jurisdiction

These Terms of Use are governed by French law. In the event of a dispute, exclusive jurisdiction is vested in the courts of Lyon.

Warning: The virtual recruiter's responses are automatically generated by artificial intelligence and do not constitute professional advice.

The AI, speech-to-text and text-to-speech providers are chosen according to the Service configuration, which may change; each simulation uses only some of them. Some processing may also run on infrastructure controlled by Namua Consulting, without any transmission to a third party. This list is kept up to date: any new provider receiving personal data is added to it before it goes live.

These service providers may temporarily process certain personal or technical data (e.g. audio excerpts, interview text, payment information) only to the extent necessary for the provision of their services. Namua Consulting does not control their retention or usage policies, but ensures collaboration only with providers compliant with the GDPR or equivalent legal frameworks, such as the EU-U.S. Data Privacy Framework.

5. Security

  • HTTPS connections;
  • Secure hosting;
  • Restricted access;
  • Periodic backups.

6. Data Protection Officer (DPO)

Namua Consulting has not appointed a Data Protection Officer (DPO), as such appointment is not mandatory under the GDPR given the nature of its activities and the volume of data processed. For any questions regarding your personal data, you may contact us at the following address: contact@namua.ai.

7. Your rights

  • Access, rectification, erasure, restriction, objection, portability.

To exercise your rights: contact@namua.ai

8. Transfers outside the EU

In the course of operating the Service, certain data may be transferred to service providers located in the United States, including:

  • Google Cloud (Alphabet Inc.) (text-to-speech, reCAPTCHA) -- certified under the EU-U.S. Data Privacy Framework (DPF) and also using Standard Contractual Clauses (SCCs);
  • Stripe, Inc. -- certified under the EU-U.S. Data Privacy Framework (DPF) for payment processing;
  • OpenAI, Inc. -- based in the United States, used for AI dialogue and feedback generation. As of this date, OpenAI is not enrolled in the DPF. Transferred data is processed in accordance with their own privacy policy, without Namua Consulting having any control over its use, retention, or potential disclosure;
  • Deepgram, Inc. -- based in the United States, used for speech-to-text and text-to-speech. Deepgram is not enrolled in the DPF. Transmitted data is managed in accordance with Deepgram's own terms and policies, without Namua Consulting exercising any control over its processing.

Mistral AI, Gladia, HOSTERFY and Plausible are established in the European Union: the data entrusted to them is not transferred outside the EU merely because of their involvement.

For DPF-certified providers (Google, Stripe), transfers benefit from a protection mechanism recognised by the European Commission. For other US-based providers (OpenAI, Deepgram), transfers are carried out on the basis of their own contractual and technical policies. Namua Consulting disclaims all liability regarding the processing, retention, use, or disclosure of data once transmitted to these third-party providers.

The Candidate is expressly informed of this transfer and accepts that Namua Consulting cannot guarantee the same level of protection as that afforded within the European Union, particularly due to the possible existence of local legal obligations allowing US authorities to access the data.

9. Cookies

The website only uses strictly necessary technical cookies (session, security). No advertising cookies are used without consent.

The Google reCAPTCHA anti-bot service, used on the registration and contact forms, analyses technical browsing data (IP address, browser, behaviour on the page) and may read or store information on your device, for security purposes only. Plausible Analytics audience measurement works without cookies and without personal identifiers. Finally, some interface libraries are loaded from third-party content delivery networks (jsDelivr, unpkg): on that occasion, your IP address and technical browsing data are visible to these operators.
